7 charged in immigration smuggling case Saturday, March 15, 2008 BY ELIZABETH LLORENTESTAFF WRITER The way Hillsdale police saw it, the nationwide debate over whether local police should help catch illegal immigrants is a moot point when you find human smuggling that includes children.

It was a broken headlight and an unreadable temporary Arizona license plate that led Hillsdale police to pull over what turned out to be a carload of smuggled illegal immigrants from Mexico on Wednesday morning, authorities say.

And although all the adults in the vehicle ended up in custody of immigration authorities, Hillsdale police say that they did not press charges or arrest the immigrants because they encountered motor vehicle violations.

Hillsdale Detective Sgt. Robert Francaviglia said it was decided to refer the matter to the Bureau of Immigration and Customs Enforcement, or ICE, after the driver admitted transporting illegal immigrants — among them five children, ranging in age from 2 to 17.

"Everyone paid $2,000 to cross the border, then they could go anywhere they wanted to in the United States," Francaviglia said.

The Hillsdale incident comes amid a national debate about when local police should act on immigration issues, routinely considered federal matters. Advocates for immigrants argue that local police should not contact ICE about immigration issues unless a crime is involved. But those on the other side of the debate say all levels of law enforcement should address illegal immigration.

Caught in between are local police agencies, especially those in areas like North Jersey that are magnets for immigrants.

Fairview has cracked down on day laborers by ticketing them for minor violations. Passaic police assisted ICE out of a sense of duty during a recent raid at homes in which residents were arrested on immigration violations. Morristown's hard-line Mayor Donald Cresitello has unsuccessfully tried to enlist town police as federal immigration agents.

And in another regional example of the controversy, a Long Island police commissioner declared that Nassau County police would no longer join in federal raids after his officers ended up detaining day laborers wanted on civil warrants; ICE had led them to believe they were rounding up gang members.

Hillsdale police "had only motor vehicle violations," Francaviglia said. "But the driver admitted that everyone was illegal, and that they were being transported from Arizona and that he knew this was illegal."

When police pulled over the Ford Excursion at 1:30 a.m., they allegedly found a dozen people inside, all Mexican nationals, including the five children.

The passengers had recently been smuggled across the Southwest border. Two of the Mexicans, including the driver, apparently had been hired by the vehicle's owner — who possibly also ran a smuggling operation from Arizona — to drop off the immigrants around the country, police say.

Some of the five men and two women were sent to the Bergen County Jail under ICE custody, Francaviglia said.

Police said the five children were "committed to the care and custody" of the state Department of Children and Families. They said four were teenagers and here without parents, though one was the nephew of an adult in the vehicle.

Police said when the driver, Cristian Soto Estevez, 26, failed to produce a driver's license, and showed only Mexican government-issued identification, Emerson police, who were assisting, got Soto to admit transporting illegal immigrants. Then they decided to contact ICE.

Hillsdale police took the group in custody until ICE agents arrived, Francaviglia said.

An ICE complaint charges that Soto admitted knowing all the passengers were here illegally and that he expected to be paid $800 to $1,000 to drop them off. The other immigrants face charges on immigration violations.

Drinking the Green Kool-Aid

Maine has a reputation of being pretty “green.” Thanks to the Natural Resources Council of Maine, Maine Audubon, and a bevy of taxpayer-subsidized nongovernment organizations, the environmental left has had a very “successful” track record in this state. Maine’s environmental left has successfully demonized corporate capitalism, perfected apocalyptic fearmongering as an agenda-setting and fundraising strategy, established environmentalism as a secular state religion (with taxpayers filling up the collection plate), all the while managing to avoid any accountability for the negative consequences of their actions. Who says it’s not easy being green?

Maine’s green agenda is even sporting a new buzzword: “sustainability.” Sustainability is at first glance an appealing concept. The idea behind sustainability is “Don’t eat the seed corn,” or more formally, don’t take actions that reduce the opportunities and prospects of coming generations. Wrapped in the politically correct swaddling clothes of the United Nations 1987 Report on the Environment (Agenda 21, or the Brundtland Report), everyone wants to be “sustainable.”

There may be near unanimous agreement on desiring good stewardship and sustainability of natural and human resources, but there is no agreement on what exactly that might mean in practice. What is or is not “sustainable” depends on assumptions about technological change, economic systems, and human nature. Thomas Malthus (father of the population explosion hysteria) made such assumptions and predicted mankind’s collapse. His heirs in today’s environmental movement employ similar tactics. Predicting apocalypse and crying wolf get you attention and funding—especially if you take steps to assure you won’t be held accountable for repeatedly and incorrectly crying wolf.

Global warming is the latest and most successful effort along these lines. Al Gore got a Nobel Prize for it. And after all, bending a little science in the name of saving the planet isn’t really a mortal sin, is it? Just a little green lie.

I am a member of the environmental right. We don’t have too many members here in Maine, certainly not in our U.S. Congressional offices or mainstream media. The environmental right includes a fellow named Bjorn Lomborg, mathematician, professor, and author of The Skeptical Environmentalist. Lomborg has this annoying habit of looking at the data (usually United Nations data) and he keeps coming back with a conclusion the wolf criers cannot abide—that air and water quality are getting better, human longevity and welfare are improving, and spending trillions of dollars to reduce greenhouse gas emissions will not avert global warming but will actually make us both poorer and less sustainable. As a result of such heretical statements, the environmental left sought to silence and demonize Lomborg. In my opinion, he should have gotten the Nobel Prize.

As part of Maine’s efforts to “fight” climate change, in August 2001 Maine signed an agreement with the Maritime Provinces and the other New England states to reduce our greenhouse gas emissions. The New England Governors/Eastern Canadian Premiers Climate Change Action Plan is essentially an updated regional version of the infamous Kyoto Protocol. (The Kyoto Protocol was of course famously rejected by President Bush in April of 2001. Somewhat less famously, the U.S. Senate rejected the terms of Kyoto 95–0 in 1997, and President Clinton, for some reason, never took it to the Senate for ratification after that.) Maine has also signed an agreement with a number of other “blue” states to implement reductions in greenhouse gas emissions, called the Regional Greenhouse Gas Initiative. This initiative, like the Kyoto Protocol, will stealthily and perhaps substantially raise energy prices, yet will avert essentially no global warming. Legislation to require disclosure of those facts was derailed by Maine’s environmental left in 2005. It seems that transparency, honesty, and accountability just won’t do in climate change policy.

There is also the small matter of the U.S. Constitution, which forbids such interstate and international agreements without the consent of Congress (Article 1, Section 10, Clause 3). Even though Senators Snowe and Collins and Representative Michaud profess to support Maine’s climate change policy efforts, they each have refused to seek congressional approval of these agreements. Attorney General Steven Rowe has indicated that under his reading of the Constitution no congressional approval is required. Apparently the green kool-aid makes details like upholding the Constitution downright distasteful.

Perhaps someday the environmental left’s stranglehold on Maine’s political culture will be broken. If that ever happens, here are the principles that must guide environmental policy:
• Good stewardship is based on facts not fears. Careful cost- and risk-benefit analysis should govern decision making, as opposed to emotional fearmongering designed to make the case for aggressive intervention.
• Wealth makes health. Growing successful economies are essential to environmental quality because they provide both the means and the desire to protect the environment. The worst environmental problems are in the third world; the cleanest environments are in developed countries.
• Technological innovation and entrepreneurship are critical for human progress. Policies that discourage prudent risk taking and new technologies out of excessive risk aversion and/or fear of technology (the precautionary principle) should not be adopted. Stifling the development of new technologies through excessive regulations only condemns much of humanity to poverty and hopelessness.
• Socialism is not sustainable. Policy prescriptions which decrease private ownership and control of the economy (capitalism) are not consistent with economic growth and will ultimately decrease both human well-being and environmental quality.
The day “green” looks like that, even I’ll drink the kool-aid.

The release then suggests that our national debate over immigration reform has fueled the increase in both. Offering no criteria as to what constitutes a hate group, manipulating the data for self-serving purposes, and then making broad, unsubstantiated conclusions, this latest release from the SPLC constitutes one of its most reckless charges to date. It is calculated to be inflammatory, tarnish the reputation of leading immigration reform groups, and shut down meaningful public policy debate about immigration reform.

"The Southern Poverty Law Center, in a report titled "The Year in Hate," said it counted 888 hate groups in its latest tally, up from 844 in 2006 and 602 in 2000.

The most prominent of the organizations newly added to the list, the Federation for American Immigration Reform, or FAIR, vehemently rejected the "hate group" label, and questioned the law center's motives. FAIR said the center was using smear tactics to boost donations and stifle legitimate debate on immigration.

"Their banner may be 'Stop the hate' but it's really 'Stop the debate,"' said FAIR's president, Dan Stein. "Apparently you can't even articulate an argument for immigration reform without being smeared."

Limit any real choices in voting, keeping the field limited to a two party system, where only the wealthy need apply. Both parties will be given scripted talking points so they don’t address the real issues facing Americans. Keep up the pretense of a representative democracy.

Dear Mr. Chief Justice Roberts,

I am writing to you as member of the Judicial Conference, which next March
11 will consider the adoption of the Revised Rules for processing judicial
misconduct and disability complaints. These Rules, just as the current ones
that they are supposed to replace, are irremediably flawed as part of the
inherently biased system of judges judging judges

Indeed, the official statistics on the disposition of such complaints show
that during the 10-year period 1997-2006, there were filed 7,462 judicial
complaints, but the judges had only 7 investigated by special committees and
disciplined only 9 of their peers! This means that the judges systematically
dismissed 99.88% of all complaints.

The Late Chief Justice Rehnquist and the Breyer Committee knew about these
statistics, yet pretended that the Act had been satisfactorily implemented.
Likewise, the Committee on Judicial Conduct and Disability pretends that if
only the rules are reworded, judges will handle complaints against
themselves as anything other than a dismissible nuisance. However, its Rules
only authorize the continuation of such systematic dismissal by:

Rule 2(b) allowing the non-application of any rule by the judges handling
complaints, thus rendering the Rules optional rather than mandatory and
ensuring their inconsistent and capricious application;

Rule 3 and its Commentary depriving the official Commentaries of any
authoritative status as well as the Code of Conduct for U.S. Judges and even
mandatory rules on gifts, outside income, and financial disclosure reporting
of any guidance value;

Rule 13 Commentary pretending that special committees may be barred from
disclosing information about judges' criminal conduct to prosecutors and
grand juries, thus providing for cover ups.

but some of the most blatant provisions to ensure the Rules'
ineffectiveness.

They also show how they are procedurally flawed, for the facts establish the
intentional circumvention of the requirement of "giving appropriate public
notice and opportunity for comment".

Therefore, I respectfully request that you and through you the Conference:

1) take cognizance of my comments, hereby submitted to both;

2) not adopt the Revised Rules;

3) in the interest of justice and the public's trust in the integrity of
judicial process, call on Congress to replace the current system of judicial
self-discipline inherently flawed through self-interest with an independent
citizens' board for judicial accountability and discipline, neither
appointed by, nor answerable to, any judges; otherwise,

4) submit the Revised Rules to public scrutiny through appropriate notice
and make public all comments thereupon submitted as well as all those
already submitted by judges and others in what was supposed to be a process
of public comment rather than a veiled opportunity for judges to indicate to
its drafting peers and the Conference how to turn the practice of
systematically dismissing judicial complaints into the official policy for
defeating the Act through self-exemption from all discipline.

I consider Wayne Hage one of the most intelligent men I ever met. On
our very first visit he was explaining the World Bank, the
International Monetary fund and how the world bankers planned on
collateralizing the world debt with land. Not just the U.S. national
debt, but the "WORLD" debt. A listener sent me a copy of a report of
the FOURTH WORLD WILDERNESS CONGRESS, which was held in Denver in
1987. Over 1500 people from sixty countries were told that wilderness
lands were to protect the reindeer, the spotted owl and other
endangered species. Ninety percent of the group consisted of
conservationts, ecologists, government and United Nations
bureaucrats. The other ten percent were world banking heavyweights,
such as David Rockefeller of Chase Manhattan Bank, London banker
Edmund de Rothschild and the Secretary of the U.S. Treasury, James
Baker, who gave the keynote address. George W. Hunt, an investment
councilor, served as official host and sat in on all the meetings. It
was George Hunt that wrote the report from which I have gleaned much
of my information. During that first three days, the group was told
that the WILDERNESS CONGRESS was about beating the ozone
deterioration and bringing the rain forests back. The following days
were closed to the public. With only the bankers in attendance, the
topics discussed centered around the creation of a "WORLD
CONSERVATION BANK" with collateral being derived from receipt of
wilderness properties throughout the world. This bank would have
central bank powers similar to the Federal Reserve. It would create
currency and loans and engage in international discounting, counter-
trade, barter and swap actions. Rothschild personally conducted the
monetary matters and the creation of this WORLD CONSERVATION BANK.
This bank would refinance by swapping debt for assets. A country with
a huge national debt would receive money to pay off the debt by
swapping the debt for wilderness lands. The plan was to swap one
trillion dollars of the Third World Debt into this new bank. In the
long term, when the countries won't be able to pay off the loans,
governments from around the world will give title to their wilderness
lands to the bankers.

George Hunt wrote: "Title to the lands will go to the World
Wilderness Land Inventory Trust. This Trust will float into the World
Conservation Bank by the unanimous decree of the world's people,
saying, God bless you for saving our reindeer. Those people at the
congress were ignorant. I'm talking about the 90% that were not the
world banking heavyweights."

Hunt goes on to say that World Bank loans, as they stand now, arenot
collateralized. They're saying, we want collateral, so when we loan-
swap this debt, we're going to own the Amazon if you default. They're
going to make their bad loans good by collateralizing them after the
fact with all of this land and somebody is going to end up with title
to twelve and a half billion acres. They have multi-trillions of
dollars upon which they can create currencies and loans and they're
going to begin to barter and counter-trade and loan-swap against the
United States. The World Conservation Bank is a scheme to monetize
land. This will function as a world central bank and out of that bank
there will grow a one-world fiat currency.

This isn't some scheme conjured up during the Bush's and Clinton
administrations. The United Nations World Commission on Environment
and Development was created in 1982. The commission published
the "BRUNDTLAND REPORT" setting the stage for unlimited enactments to
take over ecology, environmental and polllution laws throughout the
world. The report stated: "We will have a proposal for very harsh,
quasi-spiritual ecological laws for MOTHER EARTH. A MOTHER EARTH
COMES FIRST mentality will arise throughout the world."

When James Baker made his keynote speech in 1987, he stated that, "No
longer will the World Bank carry this debt unsecured. The only assets
we have to collateralize are federal lands and national parks."
Baker's definition of federal lands includes Heritage sites, of which
there are about 20 in the United States. I say "about" 20, because
they are being added on a regular basis. As I write this article
Congress is about to vote on a proposed Rim of the Valley National
Park that would include over 500,000 acres of National Forest land
and 170,000 parcels of PRIVATE property including many farms and
ranches. At the same time there is a bill before Congress called the
Northern Rockies Ecosytem Protection Act that would increase the
acreage of designated wilderness by 50% in the lower 48 states.

While our Heritage sites take in quite a large amount of territory,
such as Yellowstone National Park and Mesa Verde, the Grand Canyon
and the Everglades, other countries have much greater areas. Brazil
for example has the Amazon Conservation Complex and Canada has the
Canadian Rocky Mountain Parks. As I write this story, the list
includes 851 properties in 141 countries, comprising over one third
of the earth's land mass. Will all this land collateralize the
world's debt? Probably not, so along come NAIS (the National Animal
Identification System).

According to the United States Department of Agriculture, "The first
step in implementing a national animal identification system (NAIS)
is identifying and registering premises that are associated with the
animal agriculture industry. In terms of the NAIS, a premise is any
geographically unique location in which agricultural animals are
raised, held, or boarded. Under this definition, farms, ranches, feed-
yards, auction barns and livestock exhibitions and fair sites are all
examples of premises." That may be the definition some government
bureaucrat will give you, but the word "premises" under
the "International Criminal Court Act 2002-Sect. 4", states: The
word "premises" includes a place and a "conveyance." Why check with
the International Criminal Court Act? Because on June 8, 2007 under
Secy. of Ag. Bruce Knight, speaking at the World Pork Expo in Des
Moines, is quoted as saying, "We have to live by the same
international rules we're expecting other people to do."

Throughout the entire Draft National Animal Identification System
Users Guide, land is referred to as a PREMISES and not property.
A "Premises" has no protection under the Constitution of the United
States, while property always has the exclusive rights of the owner
tied to it. Property rights are protected by the Fifth and Fourteenth
Amendments of the Constitution.

The word "Premise" is a synonym for the word tenement. A definition
of the word tenement in law is: Property, such as land, held by one
person "leasing" it to another. Webster's New World Dictionary 1960
College Edition defines "Premises" as the part of a deed or "lease"
that states its reasons, the parties involved and the property
in "conveyance." Webster then defines "conveyance" as the transfer of
ownership of real property from one person to another. It is quite
obvious that the bureaucrats in Washington had a very good reason to
use the term "premises" and never mention "PROPERTY".

Let's take another look at the wilderness areas and the World Bank's
plans to collateralize its loans. While the wilderness areas cover
about one third of the earth's surface, they are wilderness areas for
a good reason - they are useless or difficult to homestead, farm or
use in a constructive manner. Worldwide, the best and more valuable
land is occupied by farmers, ranchers and people with the ambition to
produce. Wouldn't the World Bankers rather have some productive
property than mountains, deserts and swamps?

I am convinced that the word "premise" will put an encumberance on
your deed. The bankers say they want to monetize land. It's your land
and my land they want to monetize.

The bankers are in the process of accumulating the wealth of the
world. Very few privately owned assets can be termed "real wealth."
According to scripture, God made Abraham very wealthy, giving him
LAND, CATTLE, silver and gold. I don't know where the world deposits
of gold are stored, but I'm sure the bankers have them in their
control. That only leaves LAND and CATTLE which I believe could be
next on the list. Genesis 47 describes how Joseph had storehouses
full of grain to feed the people but he didn't have a welfare
program. During the first year of the famine, Joseph took "ALL THE
MONEY" the people had for only one year's supply of grain. The second
year he took all their cattle for another year's supply of grain. The
next year they said, "We have nothing left but our bodies and our
land. Buy us and our land in exchange for food and we and our land
will be servants to Pharaoh." Gen. 47:21 states, "And as for the
people, he removed them to the cities and made slaves of them."

James Madison made a statement concerning how our people could lose
our freedom by gradual and silent encroachment of those in power. Is
it possible that those in power today are gradually and silently in
the process of removing the people to the cities to make slaves of
them? Federalizing our land and our cattle would certainly be a step
in that direction.

We just want to add to this that leaders in the fight against the
NAIS have tracked back the 15-digit ISO number that is going on our
animals to a section in the ISO documents under FINANCE - effectively
turning our "real wealth" (animals) into CURRENCY that is now under
the control of the INTERNATIONAL BANKERS. And this was discovered
long before we heard about collateralizing of our lands in the above
article, verifying what they are saying in the article IS TRUE.

JAGCT Meeting Announcement -- March 13 Meeting

Yesterday, Bill tracked me down in Lake Havasu City (I'm on leave) to say that a few kind souls had advised him I had failed to pull the trigger on a second anonuncement for the March 13 meeting, and the fact that the first announcement failed to include a start-up time for the meeting. My apologies to all for the memory lapse on both counts.
The Jaguar Conservation Team (JAGCT) public meeting scheduled for March 13 in Lordsburg NM will begin at 1000 NM time. It will end at 1700 NM time (earlier if business has been concluded). The meeting will be at the Lordsburg Civic Center, 313 East 4th Street; phone (575) 542-9615.

The primary agenda items will include the following:

· Update on current Jaguar Conservation MOU, JAGCT signatory cooperating agencies, and acceptance of any new cooperators
· Review of cooperating agency staff commitments to JAGCT
· Update on draft final AGFD-NMDGF Jaguar Conservation Strategy, including integration of companion jaguar conservation efforts in Mexico
· Update on any petitions, legal challenges, etc. pertaining to jaguars (e.g. critical habitat, recovery planning, etc.)
· Reconstitution of all JAGCT Committees and appointment of Chairs and Co-Chairs
· Updates on jaguar monitoring and sighting reports, including the recent "Charouleau Gap Hoax" in Arizona
· The Secure Border Initiative: a briefing by the Department of Homeland Security; followed by discussion of any other Homeland Security issues along the US-MX Border that are relevant to jaguar conservation
· Other business

JAGCT meetings are open to the public. State, federal, tribal agency cooperators in the conservation project are represented at each meeting.

Urgent Request - RS 2477 Roads in Lincoln County

It is a grave day when the County Manager of Lincoln County and the County Commissioners entertain the thought of a moratorium on mining in Lincoln County, New Mexico.

But this idea has been presented to them, and it is possible that this will be decided at the next county Commission meeting on 3-14-08.

Although, this would not effect Federal Lands, it would give the Fed’s more ammunition in their quest to oust all of us from our mining lands, “ILLEGALLY I MIGHT ADD.”

An Update;

We have been fighting very hard for our rights to use these lands in our mining activities as Congress has allowed through the 1872 mining law.

Yet the USFS in their quest to stop us from mining, is using every trick they can pull from their hats.

The latest is the closing of roads in the Jicarilla Mining District and other area’s.

We have claimed these roads as RS2477 Roads to the County Commissioners, under the 1866, 1872 mining laws and under the Federal Lands Management Act of 1976, as Chairman and Co-Chairman of the Jicarilla Mining District.

So far it is my understanding that the USFS has closed some 83 “EIGHTY THREE” roads within the Mining District, and want to close more.

These road closures will not only stop most from prospecting, but will severely hamper any mining activities.

We “MUST NOT” let this happen!

As Chairman of the Jicarilla Mining District I ask that you send a notice to everyone you know. And especially those who are claim holders within the district.

We know that it is near imposable for all to make it to the next Commission meeting, So I am asking that everyone write a “ “CERTIFIED LETTER” return receipt requested, to
