2010 Census
The Bill of Rights (the first ten amendments to the U.S. Constitution) at the Fourth Amendment reads:
Amendment IV
Search and arrest warrants
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
The provisions of Title 13 requiring information other than the number of persons, ages and sexes are in violation of the Fourth Amendment. Therefore, no other information need be given. If people will just remember that Title 13 violates the fourth amendment then that is all they need to say when asked for anything other than number, age and sex. This Constitution and the Laws made in Pursuance thereof... shall be the supreme Law of the Land...all Judges shall be bound thereby...any Thing...to the Contrary notwithstanding.[Article VI, Clause 2, of the Constitution of the United States of America (1789)]
The general rule is that an unconstitutional statute, though having the form and name of law, is in reality no law, but is wholly void. Unconstitutional law bears no power to enforce, it purports to settle as if it never existed, for unconstitutionality dates from the enactment of such a law and not such time as branded in an open court of law. It confers no rights; it imposes no duties; affords no protection; it creates no office; it is in legal contemplation, as inoperative as though it had never been passed. No courts are bound to uphold it and no persons are bound to obey it.[16 Am Jur 256]
The Fourth and Fifth Amendments were described in Boyd v. United States , 116U.S. 616, 630, as protection against all governmental invasions ....of the sanctity of a man's home and the privacies of life. We recently referred[381 U.S. 479, 485] in Mapp v. Ohio, 367 U.S. 643, 656, to the Fourth Amendment as creating a ....right to privacy, no less important than anyother right carefully and particularly reserved to the people.''[GRISWOLD v. CONNECTICUT , 381 U.S. 479 (1965)]
Declaration To Make To Census Takers:"I hereby affirm that the provisions of Title 13 ....requiring me to disclose my race, personal financial data, birth date, or any other personal, private information to the Bureau of the Census, an agency of the United States government, constitutes an unreasonable, unwarranted search of my person, house, papers, and/or effects, and a governmental invasion of the sanctity of my home and the privacies of life. As such, these provisions violate the Fourth Amendment of the US Constitution, and are thus wholly void and I am not bound to obey them. I have completed the only those sections of the Census form pertaining to the Constitutionally-mandated actual enumeration, as follows:
1. The actual number of people living at the address printed on the form,excluding untaxed Native Americans;
2. Age of each person in accordance with US Const. Amendment XIV, Section 2;
3. Sex of each person, in accordance with US Const. Amendment XIV, Section 2.
I have thus fulfilled my obligation to the attainment of the actual enumeration of the populace of the United States.. Any fine or other sanction that is levied by any office or organization
stemming from the unconstitutional provisions of Title 13 in connection with my response to this or any other Census-related questioning will be challenged in a court of law.

Bull's-eye central is afoot. The thousands of volunteer census workers assigned to get answers to questions from every household in the country has launched. How old are you and members of your household? What is your religion? Have you ever been on food stamps? What is your phone number? What is your race?
Magically we have ACORN as one of the groups at the center of collecting data nationally. Don't you just want a stranger from ACORN coming to your door, saying you have to answer personal, intrusive and unconstitutional questions for the first time in our census history? According to Representative Michele Bachmann, she has stated publicly:
"I know for my family the only question we will be answering is how many people are in our home. We won't be answering any information beyond that, because the Constitution doesn't require any information beyond that."
Census bureau spokesperson Shelly Lowe didn't waste any time taking Bachmannto the woodshed by reminding her of a portion of the U.S. legal code sayingthat if anyone over 18 refuses to answer any of the questions asked by census takers you can be fined up to $5,000.
Of course, predictably, the left and census brains are implying Bachmann is above the law and any of the rest of us who might rebel by not answering intrusive questions are horribly in error and will be fined if not more consequences.
We collect census info every 10 years and it is in our constitution that we do need to reveal how many people live at our home. That is for good reason since money is allocated to various states and members are elected to officeby knowing how many people need representation in various areas around thecountry.
All manipulative and personal questions are a violation of our rights and frankly none of our Government's business. When money and potential, political representation is linked to the outcome of census numbers collected we should have all the more concern that a group like ACORN, full of indictments in over a dozen states for fraud and misrepresentation iseven involved!
The question we all should have is what is the Government planning to dowith all this personal info?
Could our personal info be ever used against us? According to Rep. Bachmann
some of the members of congress have had their web sites hacked into. How will all our private information be protected, not sold, not stolen and not used against us at some time?
The census folks and this administration say abuse of the info won't happenand we are safe. Are we safe much like the Japanese were in the 40s underFranklin Roosevelt who USED CENSUS RECORDS TO ROUND UP ALL THE JAPANESE AND PUT THEM IN INTERNMENT CAMPS. No, our Government wouldn't dream of over reaching with control and abuse on the American people.
I encourage all to think very carefully about what your rights are and whatyou should do in answering questions that are vividly unconstitutional!
With a Government that wants more and more control and already identifies masses of law abiding citizens and vets as potential domestic terrorists we must start drawing lines!!! We must draw lines of protest regarding this fraudulent over reach regarding the census; draw lines regarding intrusionon private enterprise and business, draw lines regarding loan shark like plans for additional taxes, via cap and trade, the endlessly growing stimulus bill, and potential UN, global taxation schemes a foot as we speak.We don't have a choice anymore. Those of us who want a country left mustfind our voice, really read and know our constitution, declaration of Independence and bill of rights!!! Once these truth's and foundations are inour heads, organize, march, protest where needed and get behind real publicservants!!! God bless America and our right to privacy!!!

"It would do so by creating a new market, where essentially shares of carbon allowances could be bought and sold. A power plant that needed more allowances could buy them from another that had reduced its carbon emissions. Over time, the number of allowances would shrink, forcing reductions of CO2.
Critics say such a market could be gamed by powerful interests and also would be susceptible to fraud.
Some environmentalists say a simple tax on emissions would be a far simpler way to discourage polluters and encourage green energy innovations. Such a "carbon tax" could be increased over time to spur our nation's weaning from fossil fuels. We see merit in that approach.
Another problem with Waxman- Markey is that the analysis keeps changing. An early estimate by theCongressional Budget Office suggested the cost to families could be about $1,600 a year as the ratcheting down of credits to industry intensified."

"ACORN returned to the national spotlight during the 2008 election when its employees turned in fraudulent voter registration files, including listing the Dallas Cowboys’ starting lineup as voters in Nevada. This blatant attempt at fraud led authorities to raid ACORN’s offices in the state. Not to be outdone, ACORN canvassers in Florida actually attempted to turn in forms registering Mickey Mouse as a voter. And ACORN managed to register a seven-year old girl to vote in Connecticut. The list goes on.
Nation-wide investigations into ACORN’s role in voter fraud have yielded dozens of indictments. Nevada recently charged ACORN with 26 counts of voter registration fraud and 13 counts of illegally compensating canvassers. In Pennsylvania, seven Pittsburgh-area ACORN employees were charged with falsifying voter registration forms. Six of them were accused of doing so to meet an illegal quota system."

NM 2008 Prosecutors are investigating more than 1,100 ACORN-submitted voter registration cards after a county clerk found them to be fraudulent. Many of the cards included duplicate names and slightly altered personal information.
2005 Four ACORN employees submitted as many as 3,000 potentially fraudulent signatures on the group’s Albuquerque ballot initiative. A local sheriff added: “It’s safe to say the forgery was widespread.”
2004 An ACORN employee registered a 13-year-old boy to vote. Citing this and other examples, New Mexico State Representative Joe Thompson stated that ACORN was “manufacturing voters” throughout New Mexico. 2004 A Florida Department of Law Enforcement spokesman said ACORN was “singled out” among suspected voter registration groups for a 2004 wage initiative because it was “the common thread” in the agency’s fraud investigations.

TELL THE EPA NO ON DECLARING GREENHOUSE GASES A POLLUTANT
The EPA is taking public comment with a deadline of June 23--that is next Tuesday! We must do everything we can to stop this madness! Please, please read the instructions below and send them your comments. (In case you think your official comment doesn't matter, please read my most recent op-ed commentary.) Based on the only two options they have given the American public, the choice is between bad and worse. EPA is proposing that greenhouse gases be designated as "harming public health." The only other option, a lesser standard, is "endangering public welfare." I suggest that you send them a letter/fax/email stating that both the options are untenable, but if one has to choose, select "endangering public welfare."
Personally I wonder how greenhouse gases can endanger public "health" or "welfare" when without CO2 all life would cease to exist--plants would die and oxygen would disappear = we would die. But eliminating "greenhouse gases" has become the cause-de-jour.
Would you please follow the instructions below to send your comments to the EPA? (It is not as difficult as the long instructions make it sound. The easieast is e-mail GHG-Endangerment-Docket@epa.gov [copy me] and follow the tips in#2.)

"Make no mistake, he knows exactly what he is doing. This is a first-rate power grab by a power-hungry President. You see the great thing about czar's is that they operate with impunity and they are "under the radar" when it comes to making policy. They are accountable to nobody, except the administration.
So in effect we have NON-ELECTED officials, who are backed by The White House, who are given the tools and resources to do the bidding of the President and they are accountable to NO ONE! These czar's don't have to undergo Senate Confirmation Hearings, they just get appointed.
So as long as we are going to be serving all of these "kings" we should at least know who they are. In case we need to bow to them at some point. The following is a list of Obama's Czar's/Kings:

In any event, it is all water under the bridge, the horse is out of the barn. Maybe there is something we in Otero could have done to assist in a different outcome where private property rights were not put on the chopping block, maybe not. But, I at least would like to have known about it. The media could have had a field day with this one but alas.....
What I do want you to read is a strategy memo posted on CARE. This document will show you the dissembling the enviros will engage in to meet their goals. The sad, sad irony is that they end up protecting nothing but their power and money, to hell with the resources. Oh, yes, Otero County is targeted and listed.

ORF says: Remember, yesterday ORF posted on a study by the University of Montana, the University of Colorado and the University of Northern Colorado that suggested changes in fire mitigation policies between private land owners and the federal government. The study urged more federal involvement with private land owners in forests. The study cited only 11% of wild land fires are started near privately owned lands, yet the study compelled more stringent regulation by the federal government of management policies on private property. ORF is wondering what percentage of that 11% included wild fires in the state of California as compared to the percentage of wild land fires in a state like New Mexico. What involvement will Otero County have with federal agencies like the Bureau of Indian Affairs and the U.S. Forest Service? Mountain residents need to watch this deal closely.
