CORAM NOBIS: WRIT OF ERROR

A writ of coram nobis is an order by an appeals court to a lower court to consider facts not on the trial record which might have changed the outcome of the lower court case if known at the time of trial. Coram nobis is a Latin term meaning the "error before us."

In deciding whether to grant the writ, courts have used a three-part test: a petitioner must

1. explain her failure to seek relief from judgment earlier,

2. demonstrate continuing collateral consequences from the conviction, and

3. prove that the error is fundamental to the validity of the judgment.

An example of when it might be used includes prosecutorial misconduct hiding exculpatory evidence from the defendant. A writ of coram nobis is issued once the petitioner is no longer in custody. Its legal effect is to vacate the underlying conviction. A petition for a writ of error coram nobis is brought to the court that convicted and sentenced the defendant.

Coram nobis is limited to cases in which a "fundamental error" or "manifest injustice" has been committed. A high burden of proof is required. It cannot be used to reopen and reargue points of law the courts have decided, but only to raise errors of fact that were knowingly withheld by the prosecutor from judges and defendants. A writ of error coram nobis is an extraordinarily rare remedy, known more for its denial than its approval. It is distinguished from a writ of error coram vobis which brings before the court certain mistakes of fact not put in issue or passed upon,such as the death of a party, coverture, infancy, error in process, or mistake of the clerk.

Although the Federal Rules of Civil Procedure expressly abolished the use of coram nobis in civil cases in the United States, see Fed. R. Crim. P. 60(b), the issue of the writ's availability to correct fundamental errors in criminal cases remained uncertain for many years. In United States v. Morgan, the Supreme Court resolved this question, holding that coram nobis was still available in federal court for criminal cases. See 346 U.S. 502, 512 (1954).

Annotations

Prior to the Supreme Court's 2008 decision in District of Columbia v. Heller,1 the courts had yet to definitively state what right the Second Amendment protected. The opposing theories, perhaps oversimplified, were (1) an "individual rights" approach, whereby the Amendment protected individuals' rights to firearm ownership, possession, and transportation; and (2) a "states' rights" approach, under which the Amendment only protected the right to keep and bear arms in connection with organized state militia units.2 Moreover, it was generally believed that the Amendment was only a bar to federal action, not to state or municipal restraints.3

However, the Supreme Court has now definitively held that the Second Amendment protects an individual's right to possess a firearm unconnected with service in a militia, and to use that weapon for traditionally lawful purposes, such as self-defense within the home. Moreover, this right applies not just to the federal government, but to states and municipalities as well.

In Heller, the Court held that (1) the District of Columbia's total ban on handgun possession in the home amounted to a prohibition on an entire class of "arms" that Americans overwhelmingly chose for the lawful purpose of self-defense, and thus violated the Second Amendment; and (2) the District's requirement that any lawful firearm in the home be disassembled or bound by a trigger lock also violated the Second Amendment, because the law made it impossible for citizens to use arms for the core lawful purpose of self-defense.

The Court reasoned that the Amendment's prefatory clause, i.e., "[a] well regulated

Militia, being necessary to the security of a free State," announced the Amendment's purpose, but did not limit or expand the scope of the operative clause, i.e., "the

right of the people to keep and bear Arms, shall not be infringed." Moreover, the prefatory clause's history comported with the Court's interpretation, because the prefatory clause stemmed from the Anti-Federalists' concern that the federal government would disarm the people in order to disable the citizens' militia, enabling a politicized standing army or a select militia to rule.

Further, the Court distinguished United States v.Miller,4 in which the Court upheld a statute requiring registration under the National Firearms Act of sawed-off shotguns, on the ground that Miller limited the type of weapon to which the Second Amendment right applied to those in common use for lawful purposes.

In McDonald v. Chicago,5 the Court struck down laws enacted by Chicago and the village of Oak Park effectively banning handgun possession by almost all private citizens, holding that the Fourteenth Amendment incorporated the Second Amendment right, recognized in Heller, to keep and bear arms for the purpose of self-defense.

The Court reasoned that this right is fundamental to the nation's scheme of ordered liberty, given that self-defense was a basic right recognized by many legal systems from ancient times to the present, and Heller held that individual self-defense was "the central component" of the Second Amendment right. Moreover, a survey of the contemporaneous history also demonstrated clearly that the Fourteenth Amendment's Framers and ratifiers counted the right to keep and bear arms among those fundamental rights necessary to the Nation's system of ordered liberty.

This morning, like many other Americans, ORF staff were diligently listening to several media sources giving accounts of or discussing the announced death of Osama Bin Laden. The announcement was made public last night.

As this morning's radio talk shows focused on the meaning of Osama's death to Americans and the President...a disturbing call came into the Peter Boyles show...Denver...KHOW 630AM.

The caller alleges the gatherings of Americans outside the White House and at Ground Zero were SEIU members (Service Employees International Union). The caller alleges the SEIU members were gathered at near the White House and Ground Zero when the public
announcement of Osama's death was made. Jubilant celebrations by patriotic Americans at these two locations were immediate.

ORF asks: what political expediency would President Obama garner from the death of Osama? At a time when the birth certificate issue is being hotly debated, the South has been ravaged by tornadoes, fires plague the West, and the 2012 Presidential elections are looming
in the future...who would profit from the death of Osama Bin Laden? Has Osama been dead for some time...killed in the past and the fact with held from Americans?

If the threat of retaliation from Al Queda is deemed a national security risk, what extreme measures would this President impose on Americans to protect us from terrorists?

Earth Hour: A Dissent

In 2009 I was asked by a journalist for my thoughts on the importance of Earth Hour. Here
is my response.

I abhor Earth Hour. Abundant, cheap electricity has been the greatest source of human
liberation in the 20th century. Every material social advance in the 20th century depended
on the proliferation of inexpensive and reliable electricity. Giving women the freedom to
work outside the home depended on the availability of electrical appliances that free up time
from domestic chores. Getting children out of menial labour and into schools depended on
the same thing, as well as the ability to provide safe indoor lighting for reading.
Development and provision of modern health care without electricity is absolutely
impossible. The expansion of our food supply, and the promotion of hygiene and nutrition,
depended on being able to irrigate fields, cook and refrigerate foods, and have a steady
indoor supply of hot water. Many of the world's poor suffer brutal environmental conditions
in their own homes because of the necessity of cooking over indoor fires that burn twigs and
dung. This causes local deforestation and the proliferation of smoke- and parasite-related
lung diseases. Anyone who wants to see local conditions improve in the third world should
realize the importance of access to cheap electricity from fossil-fuel based power generating
stations. After all, that's how the west developed.

The whole mentality around Earth Hour demonizes electricity. I cannot do that, instead I
celebrate it and all that it has provided for humanity. Earth Hour celebrates ignorance,
poverty and backwardness. By repudiating the greatest engine of liberation it becomes an
hour devoted to anti-humanism. It encourages the sanctimonious gesture of turning off
trivial appliances for a trivial amount of time, in deference to some ill-defined abstraction
called “the Earth,” all the while hypocritically retaining the real benefits of continuous,
reliable electricity. People who see virtue in doing without electricity should shut off their
fridge, stove, microwave, computer, water heater, lights, TV and all other appliances for a
month, not an hour. And pop down to the cardiac unit at the hospital and shut the power off
there too.

I don't want to go back to nature. Travel to a zone hit by earthquakes, floods and hurricanes
to see what it’s like to go back to nature. For humans, living in "nature" meant a short life
span marked by violence, disease and ignorance. People who work for the end of poverty
and relief from disease are fighting against nature. I hope they leave their lights on.
Here in Ontario, through the use of pollution control technology and advanced engineering,
our air quality has dramatically improved since the 1960s, despite the expansion of industry
and the power supply. If, after all this, we are going to take the view that the remaining air
emissions outweigh all the benefits of electricity, and that we ought to be shamed into
sitting in darkness for an hour, like naughty children who have been caught doing
something bad, then we are setting up unspoiled nature as an absolute, transcendent ideal
that obliterates all other ethical and humane obligations. No thanks. I like visiting nature
but I don't want to live there, and I refuse to accept the idea that civilization with all its
tradeoffs is something to be ashamed of.

Most ORF readers have either read or heard, on talk radio, the NPR debacle concerning the NPR CEO and some other intellectual elite resigning, after being caught in an ACORN style sting. The NPR dude was caught on video with some guys posing as Muslim types, who wanted to give NPR $5 million.
The NPR guy was recorded talking smack about the Tea Party, Americans, Jews, and giving credence to Islam and Sharia law and wanted to give Sharia a voice in the U.S. Why the big stink?

The Muslim Brotherhood, also called Muslim Brethren (Arabic: جمعية الأخوان المسلمون Jamiat al-Ikhwan al-muslimun, literally Society of Muslim Brothers) is an Islamic organization with a political approach to Islam. It was founded in 1928 by Hassan al-Banna in Egypt after the collapse of the Ottoman Empire.
Ideology

The Muslim Brotherhood opposes secular tendencies of Islamic nations and wants return to the precepts of the Qur'an, and rejection of Western influences. They also reject extreme Sufism. They organize events from prayer meetings to sport clubs for socializing.

The organization's motto is as follows: “Allah is our objective. The Prophet is our leader. Qur'an is our law. Jihad is our way. Dying in the way of Allah is our highest hope.”

An important aspect of the Muslim Brotherhood ideology is the sanctioning of jihad such as the 2004 fatwa issued by Sheikh Yousef Al-Qaradhawi making it a religious obligation of Muslims to abduct and kill U.S. citizens in Iraq.
Methodology

The Muslim Brotherhood is working to spread its concepts and gain more followers. They work on the levels of school students, university students, inside mosques and at work. The tools they use are cassette tapes, booklets, camps for youth in schools and universities, and recently the Internet.

On March 5 in Silver City New Mexico, a rally organized by the new group, Keep Our Forest Open www.keepourforestopen.org drew over 700 people, both citizens and elected representatives from throughout the state to voice their opposition to planned road closures and limiting of camping and hunting opportunities on the Gila Forest.

Still, the mainstream media focused the majority of their efforts in covering the rally held the previous day at Gila Hike and Bike, a private business in Silver City. A rally to support of the plan to seriously limit access to the Gila National Forest. Attending that earlier support rally, were far less than a hundred people, even after counting game commissioner Dutch Salmon and at least two dogs.

Why is the press so determined to pursue the agenda of the Environmental movement? The public is often not given the full story on events due to this strong tendency to elevate the wishes of government agencies or the small but vociferous environmental community over the interest of the general public. Here is the story on the innocuously named, Travel management plan.

The USFS proposed action, alternative G, will drastically limit where people can drive in the Gila Forest, and worse, will eliminate 93 percent of the streamside dispersed camping opportunities. This “crowding” of campers and hunters into designated camping areas will contribute to erosion problems not currently caused by dispersed widespread camping. It will also severely limit options for those who want to experience a restful and quiet forest experience. This is not analyzed in the TMP draft document.

Limited camping areas will severely impact other legitimate multiple uses that are occurring simultaneously on the forest. For instance, having 8 camps in a canyon instead of the normal 1-2 will cause stress to livestock and wildlife from the larger human presence. This will move animals into more confined areas with less human presence. Possibly even into that 93 percent of stream sides where camping isn’t allowed. This domino affect will create difficulty keeping grazing utilization under required standards and would competition between livestock and wildlife and put both in closer proximity to predators at water sites.

There is no doubt, there will be less public access to the forest if this goes through. Every visitor to NFS lands needs motor transportation to pursue his/her activity. The number of visitors who absolutely wish to avoid all motorized activities is tiny, and that number is reflected in the small number of recorded Wilderness visits compared to general forest access visits. When supporters tell you this is a compromise what they really mean is, we have a ton of wilderness opportunities we currently do not use much, but we want more, because our moral value judgment is that vehicle access is bad, so you the public, should have less of it. That is what is important to those supporters that you the public have less every time, not that compromise and equity is reached.

It doesn’t help that the USFS has removed as a priority, road maintenance choosing to focus instead on wild-land fire fighting. Budgets are limited in a strained economy but with more uses removed, reduction in multiple use generated jobs and careers are creating less production revenue for the USFS. The answer to road maintenance is not shutting more uses down but opening more up. We need more timber production, more livestock production, more recreational and hunting access opportunities. That will put more money into the local economy and in turn, more into the coffers of the agencies.

The agency instead has placed itself above Congress by attempting to create more contiguous roadless areas. It is not the agency's job to eliminate and limit multiple uses from forested areas. It is congresses job. Wilderness areas were created through the Wilderness Act through the intent of congress.

The Gila has 700,000 acres of designated wilderness for those who wish to escape the sights and sounds of vehicle recreational access, or who wish to experience a primitive hunt. To attempt to use other laws such as NEPA to create more Wilderness or to establish de-facto wilderness as is occurring in this plan, violates the intent of congress. Congress never intended the USFS to expand and create wilderness through administrative procedure. The so called Travel Management Planning process is currently ongoing in all forested regions in the United States and each plan bears close scrutiny.

Multiple use is currently the USFS prime directive. Until Congress changes that, and declares that all NFS units should seek to

create roadless and Wilderness-like characteristics, the agency is bound by law to support diversity and multiple use, and the

production of goods and services for human use.

Race a factor in school fight

A fight Wednesday at Greeley West High School was precipitated by verbal taunting, which included references of ethnicity, said Roger Fiedler, spokesman for Greeley-Evans District 6 .

The fight, which occurred in the school's commons area during lunchtime, involved five students. Minor injuries — including scratches, a split lip and contusions — were reported.

Fiedler said Thursday that witnesses to the fight said the verbal portion of the altercation included references to Cinco de Mayo, which was Wednesday.

“The school has already followed up on disciplinary consequences for those involved,” Fiedler said.

Though Fiedler said he couldn't comment specifically on the punishment handed out to the students involved in the fight, he said the student handbook states that fighting can result in a range of consequences based on its severity and a student's prior behavior. Discipline ranges from in-school counseling to a maximum five-day suspension.

Information on the fight has been forwarded to the Weld District Attorney's office for consideration of charges.

A woman called the Peter Boyle's show on May 6th. She related the events described in the Greeley Tribune article. While ORF has no way of knowing is this woman was telling the truth, this is another version of what she says happened at the high school.

Her son displayed an American Flag in the rear window of his pickup truck, which was parked in the school parking lot.

The truck was broken into and the Flag was removed.

Other students wore clothing depicting an American Flag theme.

Students celebrating Cinco de Mayo wore clothing depicting the Mexican Flag.

Students wearing Mexican Flag clothing complained to school administration that the students wearing American Flag clothing disrespected Cino de Mayo.

Forwarded to me by a friend who recently retired from border patrol in Douglas........My parents were real good friends of Bob Krentz parents and I knew Bob when we were kids and I lived across the border from Douglas in Agua Prieta. Their ranch was just on the other side from the ranch owned by a doctor that was a partner of my Dad's. Such a shame, real nice fellow.

As you know, one of the local ranchers was murdered in Douglas two weeks ago. His funeral is
tomorrow. I received three messages similar to the one below from different officers within the
Rangers and law enforcement.

Yesterday afternoon I talked to another rancher near us who is a friend of ours and whose great
grandfather started their ranch here in 1880. These are good people.

He told me what really happened out at the Krentz ranch and what you won't read in the papers.
The Border Patrol is afraid of starting a small war between civilians here and the drug cartels in
Mexico .
Bob Krentz was checking his water like he does every evening and came upon an illegal who was
lying on the ground telling him he was sick. Bob called the Border Patrol and asked for a medical
helicopter evac. As he turned to go back to his ATV he was shot in the side. The round came from
down and angled up so they know the shooter was on the ground. Bob's firearm was in the ATV so he
had no chance.

Wounded he called the Cochise County Sherriff and asked for help. Bleeding in the lungs he called
his brother but the line was bad so he called his wife but again the line was bad. Several
ranchers heard the radio call and drove to his location. Bob was dead by this time. The ranchers
tracked the shooter 8 miles back towards Mexico and cornered him in a brushy draw. This was all
at night. The Sherriff and Border Patrol arrived and told them not to go down and engage the
murderer. They went around to the back side and if you can believe it the assassin managed to get
by a BP helicopter and a Sherriff's posse and back to Mexico . So much for professional help when
you need it.
One week before the murder Bob and his brother Phil (who I shoot with) hauled a huge quantity of
drugs off the ranch that they found in trucks.
One week before that a rancher near Naco did the same thing. Two nights later gangs broke into his
ranch house and beat him and his wife and told them that if they touched any drugs they found they
would come back and kill them. The ranchers here deal with cut fences and haul drug deliveries
off their ranches all the time. What ranchers think is that the drug cartels beat the one rancher
and shot Bob because they wanted to send a message. Bob always gave food and water to illegals
and so they think they sent the assassin to pose as an illegal who was hungry and thirsty knowing
it would catch Bob off guard.
What is going on down here is NOT being reported. You need to tell people how bad it is along the
border. Texas is worse. Near El Paso it's in a state of war. 5000 people were killed in Ciudad
Juarez last year and it's over 2000 so far this year. Gun sales down here are through the roof
and I get emails from people wanting firearms training.

Something has to be done but I don't hold out much hope. These gangs have groups in almost every
city in the US . This is serious business. The Barrio Azteca and their sub
gangs are like Mexican Corporations and organized extremely well. If this doesn't get dealt with
down here you guys will deal with it on your streets. Bud

The news from the British Institute of Astrophysics warns that the current position of the planet Jupiter will cause the Van Allen magnetic belts surrounding the Earth to 'wave fluctuate' causing a 'wave length generation depletion' of Earth's gravity. Essentially, what this means is a lose of 30%-50% of Earth's gravity. Archeologists suggest this happened once before during the Jurassic period in Earth's history. What this means for present day civilization is disaster. The obvious impact on several levels are cited in a report (that has been purposely repressed by the United Nations and the federal government of the United States). The lose of gravity is expected to occur, starting May 17 and last approximately 72 days. This is what will happen:

1) Air travel will cease, as airplanes would be jettisoned into the stratosphere and beyond.

2) All utilities based on turbine generated power would become useless as turbines depend on gravity to accomplish cyclic power generation.

3)Water contained in oceans, seas,lakes and rivers would become what is referred to as 'poly-water', rising into the atmosphere, creating 'poly-oxygen- or a thick soup of air heavily contaminated with water molecules too thick for air breathing species to breath.

4) Any mobile object to include humans, animals, vehicles, winds, etc. would gradually float beyond the gravitational pull of the planet and be drawn into the infinity of space. This includes radio and TV signals and the internet, which will all be useless as any mega-hertz or electrically generated signal will be siphoned into the Van Allen belts.

5)World governments will try to repress mass panic by reassuring their populations that there is nothing to fear while attempting to save a select few for re-population of the planet.

6) After the 72 days of gravitational loss, the planet will be void of most species, including mankind.

7) Those fortunate few who do survive face a rebuilding time frame of maybe...1200 years to get back to where the 'world ended' in 2010.

Why hasn't the government or any other international organization issued warnings or attempted any kind of precautionary measures to save human lives?

Datuk Bandar Datuk Ahmad Fuad Ismail said City Hall used to spend RM1.5 million ($635,100) a month to plant and maintain flowers in the city, but the contractor's services were terminated in March last year.

City Hall has taken over the planting, opting for bou-gainvillea and the tropical shrubs, Ixora, for their durability and cheaper cost.

Under the previous arrangement, some of the small flowers cost RM3.50 per seedling.

"It was getting too costly to beautify the city. Flowers were dying fast," he said, adding that City Hall would continue to plant shady trees more suited for soaking up the increasing pollution and coping with global warming.

Latif said UKM might have offered plausible reasons as to why some pollinators were not spreading flower seeds, a pattern caused by the missing "scent trail" with scent tissues burning easily due to global warming.

"The aroma producing chemical compounds in flowers dry up faster now compared with before."

The only way out, he said, was to genetically modify the flowers so that the effects would not be permanent and the future generation would not be robbed of nature's beauty.

"The act is almost like producing essential oils. Scientists add on certain chemicals for stronger scent."

He said scents in flowers last longer in colder climate as plants can hold on to their essential oils longer.

"The flowers may still have strong scents in colder climate. But locally, we fear this might be lost forever."

With flowers emitting lesser scent, the insects and butterflies are travelling further and longer to get a share of nectar.

Latif said birds and insects were heading towards hilly areas and deeper into the jungles where the weather is cooler.

He related an incident in Sungai Siput, Perak, where the farmers failed to get fruits from their orchards.

Upon investigation, Latif's team discovered that the flowers were no longer pollinating after dust from a hill blast blocked the growth of stigmas.

He said Malaysians could no longer rely on nature to heal itself without the help of science.

He said Malaysia needed to follow in the footsteps of Japan, Europe, the United States, China and South Korea which have invested millions in the research of genetically modified seeds.

Forest Research Institute Malaysia (FRIM) director-general Datuk Dr Abdul Latif Mahmod said recently the extreme weather change might affect the life span of trees as a result of lighter or heavier rain.

"We should look at how trees can be mutated so that they will not be destroyed."

He said experts, including from FRIM, should look at ways to prolong the lifespan of certain plants.

Meanwhile, Natural Resources and Environment Deputy Minister Tan Sri Joseph Kurup said given the extreme climate changes, every country should work together and not in isolation.

He said the decline in global biodiversity and ecosystem services urgently called for proactive measures.

"Both policy-makers and researchers need to work hand in hand to strengthen forest genetics, breeding and conservation."

MIAMI, March 22 (Reuters) - Florida's attorney general will file a lawsuit with nine other state attorneys general opposing the healthcare legislation passed by Congress, a spokeswoman said on Monday.

"The health care reform legislation passed by the U.S. House of Representatives last night clearly violates the U.S. Constitution and infringes on each state's sovereignty," Florida Attorney General Bill McCollum, a Republican, said in a prepared statement announcing a news conference.

"On behalf of the State of Florida and of the Attorneys General from South Carolina, Nebraska, Texas, Utah, Pennsylvania, Washington, North Dakota, South Dakota and Alabama if the President signs this bill into law, we will file a lawsuit to protect the rights and the interests of American citizens." NEW YORK, March 22 (Reuters) - Virginia's attorney general said he plans to sue the federal government over the healthcare reform legislation, saying Congress lacks authority to force people to buy health insurance.

Attorney General Kenneth Cuccinelli, a Republican, said on Monday that Congress lacks authority under its constitutional power to regulate interstate commerce to force people to buy insurance. He said the bill also conflicts with a state law that says Virginians cannot be required to buy insurance.

"If a person decides not to buy health insurance, that person by definition is not engaging in commerce," Cuccinelli said in recorded comments. "If you are not engaging in commerce, how can the federal government regulate you?"

Cuccinelli said he plans to file his lawsuit in federal court in Richmond, Virginia, after President Barack Obama signs the bill into law, which he is expected to do.

The bill requires most Americans to have health coverage, and provides subsidies to help lower-income workers afford it. [ID:nLDE62L01U]

Betty Ayleene Stoots, 77 --- Otero County Pioneer Family

Betty Ayleene Stoots, a lifelong Otero County resident, passed away Thursday, March 18, 2010 at her home.

She was born April 27, 1932 in High Rolls, NM. She married Junior Lee Stoots on July 4, 1964 in Carrizozo, NM. She has served her community in many ways.
Betty was the past President of the Otero County Cow Belles, People for the West and People for Otero County. She was also the Legislative Secretary for the Republican Women of Otero County and passionately involved in Constitutional rights issues.

Betty Stoots is survived by her husband, Junior Lee Stoots of the family home; son Jim Trice and his wife Sherri of Islamorada, FL; sister, Martha Jean Coody and husband, Jim of Barry, TX; two sister-in-laws, Joyce Talent and Wanda Newman; three grandchildren, Lee Trice, Dustin Trice and Danielle Trice; one cousin, Carol Wood; nephews Jesse Coody and David Coody; niece Kathy Lindsey; three great nieces, Sue Gregory, Paige Coody, and Stephanie Lindsey and two great nephews, Jace and Doss Coody. She had numerous friends, to include; G.B. Oliver III, Mike Haymes, Jimmy Goss, Ellis Neel and Leroy Lewis and Sisters in Christ, Estelle Moser, Yvonne Oliver, Sassy Tingling, Jean Vallance and Frances Goss.

Honorary Pallbearers will be John Oliver, Carl Vallance, Melvin Lester, Mike Shinabery, Bobby Jones and Jim Coody.

Memorial services will be 1 p.m. Tuesday, March 23, 2010 at the Alamogordo Funeral Home Chapel with Ronny Rardin officiating. There will be a reception held at the Saving Grace Church, 49 K.C. Road immediately after the memorial.

Her youngest son, Dan Alan Trice and her parents Wilson and Susie Mae Bennett preceded her in death.
